INTRODUCTION

General Terms.

We appreciate you picking us. Please carefully read these General Terms of Service (“General Terms”) before continuing. The Coinsafe VPN (collectively, the “Service” or “Services”) that you use and access is covered by the General Terms, among other things. The use of and access to Coinsafe VPN’s websites (the “Websites”) are governed by these General Terms as well.

Subscription.
We offer all of our paid services on a subscription basis. If you don’t cancel your subscription before the auto-renewal, the supply of the Services will automatically renew at the conclusion of the current Subscription period. Please read the Subscription Terms for an overview of the important elements relating to your Subscription of our Services.

Terms.
The “Terms” refer to these general terms, the subscription terms, and any service-specific terms that may be relevant.

Coinsafe VPN. For the purpose of the Terms, “Coinsafe”, “we”, “us”, or “our” means Coinsafe VPN Trading as Doodlo Design Studio Ltd registered at 7 Bell Yard, London, England, WC2A 2JR.

Privacy. For information about how we collect and process your personal data, please read our Privacy Policy.

YOUR AGREEMENT WITH COINSAFE VPN

Binding Legal Agreement. Note that you or the people you are legally obligated to represent (“you”) and Coinsafe VPN are bound by the Terms. By (i) opening an account to utilise Services (an “Account”); (ii) downloading software; (iii) accessing/using its services and websites; or (iv) in any other way electronically accepting these Terms, you agree to be bound by them. If you are using the Services on behalf of an organisation, you are acknowledging that you have the power to bind that organisation to these Terms and that you are authorised to act on that organization’s behalf.

You are given our services subject to your acceptance of these terms. PLEASE CAREFULLY READ ALL OF THEM. Please refrain from accessing and using our services and/or websites if you do not agree to be bound by these terms or any of its provisions.

Services.
Our Services are usually provided as paid Services. We also may offer a version of certain Services which is provided free of charge. The Terms apply to both types of Services.

Accessing the Services and/or Websites.
In order to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms and to abide by and comply with them, you hereby represent and warrant that you are at least eighteen (18) years old or have the authority to act on behalf of a legal entity.

Updates to the Terms.
We regularly add new features to our Services and Websites while also updating existing ones. Additionally, we may need to periodically update the Terms by amending them to:

• comply with applicable laws;
• follow regulatory authorities’ orders or recommendations;
• add new functionality, services, features, technologies, and/or benefits;
• fix bugs;
• make the Terms clearer;
• stop abuse or harm;
• for any other justification, such as security concerns. You acknowledge and agree that it is your responsibility to periodically examine the Terms in order to stay informed of any changes to the rules and obligations. Any significant modifications to the Terms that have an impact on your rights or responsibilities will be communicated to you in advance via reasonable means (such as email). Unless otherwise specified by us, each modification to the Terms is effective as of the time they are published. It will be assumed that you accept these terms if you continue to use the Services.You can also terminate your relationship with us at any time after the effective date of the updated Terms by closing your Account and/or not accessing our Services and Websites.

THE TERMS MAY CHANGE, SO IT IS IMPORTANT TO REVIEW THE TERMS PERIODICALLY.

SUBSCRIPTION AND AUTO-RENEWALS

Subscription.
We offer all of our paid services on a subscription basis. When you acquire the Services, you get to decide the duration and the mode of payment. To learn more, please see the subscription terms.

Auto-Renewal.
Unless you choose to cancel the Subscription renewal before the day of the charge, after the end of your Service period, your Subscription will automatically renew for the following defined Service periods at the renewal dates. Your preferred payment method will be charged the then-current renewal price for the upcoming specified Service period if you don’t cancel the Subscription in due time.

YOUR USER ACCOUNT

Creating an Account. You must create an Account by entering specific information (such as your email address, password, billing information, and nationality) in order to access and use any of our Services. You must always keep your information current, accurate, true to the facts, and comprehensive. No Coinsafe VPN Account may be transferred.

Confidentiality of and Access to the Account.
You acknowledge that you alone are liable for any and all actions taken using your account or password, including but not limited to the use of the account by anyone else, with or without your consent. You are in charge of protecting the privacy of your Account’s password and preventing unauthorised access to your Account. Keep your password a secret to secure your account. Never use the same password for more than one service. You commit to let us know right once if your account or password is ever used without your permission.

PRICES AND PAYMENTS

Total Price.
Prices for our Services that were first displayed to you could not have included taxes. Because of the global scope of our Services and the mobility of our customers, we might not be able to predict the specific taxes that will apply to you in advance. Only once you select your tax residence country can we calculate the additional mandatory taxes (such as sales tax, value-added tax, or another mandatory tax under laws applicable to you). In any event, before charging your account, we will show you the exact amount of additional taxes that apply to your purchase.

Payments.
You agree to reimburse us for any purchased Services you obtain from us as well as for any other expenses made through your Account, including any applicable taxes and service costs. If we do not promptly receive your full payment, we reserve the right to suspend or terminate the Services. Suspension or cancellation of the Services for non-payment could result in a loss of access to and use of your Account and its content.

Recurring Payments.
If you choose to pay for the Services on a subscription basis (monthly, annually, or otherwise), you acknowledge and agree that:
(i)  the Services will automatically renew until you cancel them

(ii)you are authorising recurring payments
(iii) payments will be made to Coinsafe VPN by the method and at the recurring intervals you have agreed to, and
(v) when applicable, Coinsafe VPN may obtain and use updated card account information from the financial institution that issued your card Please review our Subscription conditions for additional details about the Subscription and how to cancel it.

Payment Methods.
You must give us a current, legitimate payment method, such as a credit card, debit card, or any other option made available on the Websites, in order to purchase Services directly from us through our Websites.

Billing.

By providing a payment method to Coinsafe VPN, you (i) confirm that you have the right to use it and that all payment information you provide is true and accurate; (ii) give Coinsafe VPNpermission to charge the payment method you provided; and (iii) give Coinsafe VPNpermission to charge you for any paid Services you selected when making a purchase. You can log into your Account at any time, click the “Billing” button, and then under the Section “Billing history” generate the receipt/invoice by selecting “Get invoice” to check your billing history and manually generate receipts and invoices for our Services. Please get in touch with us if you have any payments-related inquiries.

Payment Processing. Coinsafe VPN also reserves the right to

• obtain and continue using updated credit card account information electronically, when applicable, from the card brands,
• retry failed payments to complete transactions, including but not limited to, retrying failed cards with extended expiration dates and,
• change or amend authorized payment companies to assist with payment processing.

Fraud Protection.
Coinsafe VPN reserves the right to verify credit/debit card payments prior to completing your purchase.

Change of Prices.
We reserve the right to adjust the cost of our paid services, including subscription renewal fees, as necessary to reflect changes in the overall expenses of providing our services. In addition to state-imposed fees, contributions, taxes, and duties, licencing costs, costs for the technical provision and distribution of our Services, additional costs of sales (such as billing and marketing), general administration, and other overhead costs are a few examples of cost elements that have an impact on the price of our Services. Any price adjustments won’t affect the duration of your current subscription and won’t take effect until that subscription is renewed.We will always send you a notification prior to charging with an upcoming payment amount.

Subject to applicable law,

(i) if you disagree with any proposed change of renewal price, your sole remedy is to cancel your Subscription before the next charge is made, and

(ii) your continued use of the Services without cancelling the Subscription constitutes your agreement to pay the new renewal price for the Services.

Changes of Payment Details.
Please notify us as soon as possible if any of your payment information changes (such as the card’s expiration date or number), so that we can continue to offer the Services when the Subscription is up for renewal. If you change your payment information in your account, all subsequent payments will be made using the updated information. Occasionally, your card issuer or the card network may send us updated credit card or debit card information, which Coinsafe VPNwill use to automatically update your payment information.

Free Trials.
In some instances, we or third parties acting on our behalf may provide a free trial for our paid services (“Free Trial”) before billing your payment method. The length, use, and other specifics of the Free Trial will be made clear at the time of sign-up and/or in the advertising materials. To the extent permitted by applicable law, we evaluate your eligibility for the Free Trial at our sole discretion and may limit or discontinue the Free Trial option at any time without prior notice. If you enter your payment information while signing up for a free trial subscription, we will automatically charge you for the subscription and it will continue to renew until you cancel it. You must cancel a paid Subscription before the Free Trial expires if you do not wish to continue with it after the trial period. If a third party provided the free trial, you can cancel the premium subscription through that entity. We retain the right to forbid the combination of free trials or other promotional offers and to restrict you to a single free trial or promotion of a paid Service.

CANCELLATION AND REFUND POLICY

Subscription Cancellation.

You have the right to cancel your Subscription at any time, stopping auto-renewals for the following Service period (please note that cancelled Subscriptions will not get a reimbursement for the portion of the current Service month that has not yet been used). Depending on whether you acquired Services through (or are billed via) Coinsafe VPNor a third party (e.g., app store, service provider, merchant), your options to cancel the Subscription and/or seek a refund may vary.

Refund.
We want you to be completely satisfied with our services. However, if you are dissatisfied with our Services, you have thirty (30) days from the date of purchase to cancel the Subscription and ask for a refund (“Money Back Guarantee”). Please be aware that, unless otherwise provided by relevant legislation, we do not offer a money-back guarantee if you cancel your auto-renewed subscription after the day on which the renewal fee was charged. In any case, before you decide to ask for a money-back guarantee, we would be happy to help you with a problem you encountered.

Eligibility for Refund.

The Money Back Guarantee only allows you to request a refund for each of our Services twice. If you purchase a certain service once more following the second refund for that service, you will not be eligible for a money-back guarantee for any other cancellations. If you decide to end your subscription at any time after the end of the applicable money-back guarantee period, you will be charged for the entire duration of the subscription (for example, if you buy an annual subscription and decide to end it after two (2) months, you will be charged the full price, but the subscription will not be renewed after that point).

Purchased Subscriptions from the Apple App Store. Apple App Store refund policies apply to subscriptions that are bought there. This implies that if you bought something through the Apple App Store, we are unable to give you a refund. To learn more, see Apple’s in-app purchase refund policy or get in touch with store support. If you have an Apple App Store-purchased subscription that automatically renews and would wish to cancel it, you must do so through your Apple App Store account. Purchased Subscriptions from other Providers. Refunds for purchases made through third-party marketplaces, shops, and resellers (such as Amazon, BestBuy, StackSocial, etc.) are handled in accordance with their terms of service. The terms of some providers may also apply to the cancellation of such Subscriptions.

Canceling the Auto-Renewal of the Subscription Purchased on our Websites.

You can discontinue an automatically renewing subscription that you have purchased from one of our websites by logging into your Coinsafe account at any time. For the unused portion of the active Service period, cancelled Subscriptions will not be repaid.

LICENSE TERMS

Software.

You might need to download and install our Software on a device in order to use our Services. The terms and conditions that apply to using such software are listed below. In accordance with these Terms, “Software” refers to any desktop and mobile software applications, as well as any other software (including any releases, updates, enhancements, or revisions) and any documentation that comes with or is made available in connection with such software and is provided to you by us in connection with your use of the Services.

License Grant.
We hereby grant you a limited, revocable, non-exclusive, personal, non-transferable, non-sublicensable, non-assignable, fixed-term licence (the “Licence”) to download, install, and use a copy of the Software on a compatible device that you own or control, subject to the terms and conditions of these Terms and provided that you comply with the Terms. You are not given any other express or implied rights or licences of any kind with regard to the Services and/or Software by this agreement.

We Retain all Rights.

You do not acquire any ownership rights to any copies of the Software used in accordance with these Terms or to the Software itself, and this is especially true of the Services and Websites. The Software is licenced, not sold. Other than the rights expressly given in these terms of service, you have no other rights to the Software.

The Services and Software version that is offered at the time of your renewal date can be different from the version that was offered when you first bought your Licence from us. For at least two (2) years following the initial release of an OS version, we offer programme updates for all OS versions.

Feedback.
By communicating Feedback (defined below) to us, you hereby grant Coinsafe VPN and/or its connected companies a perpetual, irrevocable, global licence to use it without payment or other consideration, without being required to report on its usage, and without any other limitations. Any and all rights, including moral and comparable rights, that may now or in the future exist with regard to the Feedback are waived (or agreed not to be enforced). “Feedback” refers to any suggestions, ideas, proposals, reviews, or other comments relating to our services, software, or websites.

PROHIBITED AND RESTRICTED USE

The Terms and all relevant laws and regulations must be followed in order for you to access and use the Services and Websites. We reserve the right to suspend and/or terminate the Accounts and/or Services for any users who violate any applicable laws or these Terms, whether repeatedly or just once, at any time, in our sole discretion, with or without warning. Please review Section 12 of the General Terms (“Suspension and Termination”) for more details.

You agree that you shall not yourself and/or enable others to:

• use, assist, encourage, or enable others to use the Services/Websites for any unlawful, illicit, illegal, criminal, or fraudulent activities, including but not limited to port scanning, sending spam, sending opt-in email, scanning for open relays or open proxies, sending unsolicited email or any version or type of email sent in vast quantities even if the email is routed through third-party servers, any pop-up launching, use of stolen credit cards, credit card fraud, financial fraud, cryptocurrency fraud, cloaking, extortion, blackmail, kidnapping, rape, murder, sale of stolen credit cards, sale of stolen goods, offer or sale of prohibited and dual-use goods, offer or sale of controlled substances, identity theft, hacking, pharming, phishing, scraping in any form or scale, digital piracy, conduct distributed denial-of-service (DDoS) attacks, and other similar activities;

• use the Services/Websites for any military purpose, including cyber warfare, weapons development, design, manufacture, or production of missiles, nuclear, chemical or biological weapons;

• assault, interfere, gain unauthorized access, deny service in any way or form to any other network, computer, or node through our Services/Websites;

• exploit children in any way, including audio, video, photography, digital content, etc.;

• violate, infringe, or misappropriate Coinsafe VPN, our licensors and/or any other third parties’ copyright, other intellectual property rights, privacy, or other legal rights;

• communicate, transmit, store, make available, share anything that is illegal, abusive, harassing, or otherwise objectionable (objectionable means anything which interferes with the rights of Coinsafe VPN, its users, or other third parties, or causes conditions that are dangerous, hazardous, and detrimental to others, or anything that most users and/or Coinsafe VPN would find to be offensive or inappropriate);

• transmit any viruses or other computer codes, files, programs, instructions, or technological means that disrupt, damage, or interfere with the use of computers or related systems;

• attempt to circumvent any technological measure and/or arrangement implemented by Coinsafe VPN and/or its licensors, or by the owner of the resource or the source of the material that the technological measure protects;

• interfere with or disrupt the integrity or performance of the Service/Websites;

• take any action that imposes or may impose an unreasonable or disproportionately large load on our infrastructure;

• sublicense, sell, resell, transfer, assign, distribute, or otherwise commercially exploit or make available to any third party the Services, Subscription, and/or Account in any way;

• use any robot, spider, scraper, or other automated means to access our Websites or Services for any purpose without our prior written permission;

• build a product using similar ideas, features, functions, or graphics of the Service/Websites or copy any ideas, features, functions, or graphics of the Services/Websites;

• claim that you are the representative or agent of any of the Services, including any of its functionality;

• threaten, stalk, harm, or harass others, or promote bigotry or discrimination;

• attempt to gain unauthorized access to the Services, Accounts, computer systems, or networks connected to the Services through hacking, password mining, brute force, or any other means;

• violate general ethical or moral norms, good customs, and fair conduct norms;

• use the Services/Websites for anything other than lawful purposes;

• consistently demonstrate unrespectful, threatening, offensive, and/or malicious behavior when communicating with Coinsafe VPN customer support and/or other employees;

• access and use the Services if you have been or are prohibited to access the Services, or if your Account has been suspended or terminated due to any reason;

• share non-public features or content of the Software and/or Services with any third party;

• to the extent permitted under applicable law, otherwise violate or attempt to evade, or circumvent these Terms.

Additionally, you must refrain from taking any action that would impair, restrict, or otherwise interfere with our ownership of and rights to the Services. Except and only to the extent expressly permitted by applicable law and these Terms, you are not granted any rights and shall not permit anyone else to:

• reproduce, modify, distribute, make available over network, publicly display, or publicly perform the Services, Software, or Websites;
• reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, business secrets, or other proprietary information of the Software, Services, or Websites.
• translate, adapt, arrange, or make any other alteration of the Services, Software, Websites, and reproduce the results thereof;
• transfer, distribute, lease, sublicense, or rent the Services, Software, Websites, and/or your rights granted under the License to any third party; (v) use the Services, Software, Websites in any manner that is not expressly permitted pursuant to the Terms;
• remove or modify markings or any notice of proprietary rights of the Services, Software, Websites.

To prevent misuse of our services and detect web scraping, we employ automated techniques. When new sessions are started, these tools scan for unusual patterns, and if any are found, your Account may be automatically suspended or your access to the Services restricted until further investigation is complete.

It is your duty to be aware of all applicable laws in any jurisdiction or venue that have any bearing on you, your conduct, or your use of the Services. You choose to use the Services in your country and access them on your own initiative. If and to the extent that local laws and regulations are applicable, you are solely responsible for abiding by them as well as the laws and regulations of any other country with which or through which you communicate, transmit, or receive data.

We encourage you to let us know about the violation of these Terms by any of Coinsafe users or other third parties by contacting us (“Contact Us”). In case of such violations, we may take appropriate action at our sole discretion.

DISCLAIMER OF WARRANTIES

It is your duty to be aware of all applicable laws in any jurisdiction or venue that have any bearing on you, your conduct, or your use of the Services. You choose to use the Services in your country and access them on your own initiative. If and to the extent that local laws and regulations are applicable, you are solely responsible for abiding by them as well as the laws and regulations of any other country with which or through which you communicate, transmit, or receive data.
In exceptional and very limited cases, our Services may be unavailable from time to time due to human, digital, mechanical, telecommunication, software, and other failures. We cannot predict or control when such downtime may occur and cannot control the duration of such downtime.

THE WEBSITES AND SERVICES ARE AVAILABLE “AS IS” AND WITH ALL FAULTS. ABOUT THE COMPLETENESS, ACCURACY, ADEQUACY, SUITABILITY, FUNCTIONALITY, AVAILABILITY, OR OPERATION OF THE SERVICES, WE MAKE NO REPRESENTATION OR WARRANTY WHATSOEVER. You acknowledge that we have no control over how you use the services, and that we make no representations or warranties about their functionality or end results.

YOU AGREE TO TAKE ALL RISKS ASSOCIATED WITH USING THE SERVICES, AS WELL AS ALL LIABILITY FOR LOSS OR MISINTERPRETATION OF ANY DATA OR INFORMATION. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING THROUGH COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE. Without limiting the aforementioned, WE NEITHER WARRANT NOR REPRESENT THAT YOUR USE OF THE SERVICES WILL NOT VIOLATE ANY THIRD PARTY RIGHTS, THAT YOU WILL BE ABLE TO ACCESS OR USE THE SERVICES, OR THAT THE SERVICES WILL OPERATE ERROR-FREE OR UNINTERRUPTED.
A FEW OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU DUE TO THE FACT THAT SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES. APART FROM THE RIGHTS LISTED ABOVE, YOU MAY ALSO HAVE OTHER RIGHTS THAT DIFFER FROM JURISDICTION TO JURISDICTION.

LIMITATION OF LIABILITIES

You should be aware of the dangers involved before using the Services since they are inherent in using, transmitting, or retrieving any data and/or content from the internet. When users access or utilise the Services/Websites, Coinsafe VPNexpressly disclaims any liability for their actions.

YOUR USE OF THE SERVICES AND WEBSITES IS AT YOUR OWN RISK. NEITHER COINSAFE, NOR ANY OF ITS PARENTS, SUBSIDIARIES OR AFFILIATES, NOR ANY OF THEIR EMPLOYEES, OFFICERS OR DIRECTORS, SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR OTHER DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF DATA OR INFORMATION OF ANY KIND, LOSS OF BUSINESS, LOST PROFITS, INTERRUPTION OF BUSINESS, COST OF COVER OR ANY OTHER DAMAGES) ARISING OUT OF OR IN ANY WAY RELATED TO THESE TERMS OR THE USE OR INABILITY TO USE THE SERVICES OR WEBSITES, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Regardless of any laws or statutes that may require otherwise, Coinsafe’s total cumulative liability arising out of or related to these terms shall not exceed the amount you paid to Coinsafe during the twelve (12) months immediately preceding the event giving rise to such liability. It also shall not include attorney fees or court costs. You acknowledge that Coinsafe VPNWOULD NOT HAVE ENTERED INTO THE AGREEMENT WITH YOU WITHOUT THE LIMITATIONS ON ITS LIABILITY CONTAINED IN THIS SECTION AND THAT THE AMOUNT OF FEES PAYABLE BY YOU TO Coinsafe VPNHEREUNDER REFLECT THE ALLOCATION OF RISK SET FORTH IN THE TERMS.

The restriction of liability for death or physical damage brought on by the negligence, fraud, or fraudulent misrepresentation of another party, as well as for deliberate misconduct or gross negligence, is prohibited or restricted in some jurisdictions. As a result, you might not be covered by the relevant provisions of this Section. When these limitations on liability apply, Coinsafe VPNliability will be constrained to the utmost degree allowed by the relevant legal provisions. Please also note, that Coinsafe VPN has implemented security measures aimed at securing the Services and Websites; nevertheless, the internet is not a secure network and system reliability could be impaired independently of Coinsafe VPN’s efforts and will. In addition, Coinsafe VPNcannot be held liable for unpredictable events such as cyber attacks, security breaches regarding the transmission of data or for performance guarantees regarding the volume and speed of data transmissions. Users are responsible for taking all appropriate measures to protect their own data, software, equipment, and systems, particularly from contamination by any viruses circulating on the internet.

INDEMNIFICATION

You consent to protecting Coinsafe VPN, its parents, subsidiaries, and affiliates, as well as their officers, directors, employees, agents, distributors, and licensees, from and against any judgements, losses, deficiencies, damages, liabilities, costs, claims, demands, suits, and expenses (including, without limitation, reasonable attorneys’ fees, expert witness fees, and expenses) incurred in, arising from, or in any way connected to

• your use of the product.
• Your breaking any applicable laws, rules, or regulations;
• Your carelessness or wilful wrongdoing; or (
• Your negligence. Any delay or disruption in your use of the Services, as well as any losses resulting from it, caused by events covered by this Section will not be the fault of Coinsafe VPN.

SUSPENSION AND TERMINATION

Suspension and Termination by Coinsafe VPN. We may suspend (for clarification, investigation, or when requesting you to explain your actions) or terminate your Account and/or Services, if (i) we cannot charge you for the auto-renewed Subscription, (ii) you breach Section 8 of the General Terms (“Prohibited and Restricted Use”), (iii) you breach any applicable laws, (iv) it is required to do so by law or competent authority (e.g., where the provision of the Services becomes unlawful in your country of residence, or final court judgment bearing relation to your use of our Services, Software, or Websites is issued).

Before suspending or terminating your Account and/or Services, we will offer you a reasonable opportunity to resolve the problem if the circumstances call for it. To get further information, but, if your Account has been suspended, you must get in touch with us. Before permanently terminating your Account, we may (but are under no obligation to) suspend it for a reasonable amount of time.

Prior to suspending or terminating your Account and/or Services, we will typically send you a notification. If you are in violation of Section 8 of the General Terms (“Prohibited and Restricted Use”) or any applicable laws in a way that puts us or another party in immediate danger or disrupts our Services, we may not be able to send you a notice before terminating your access to our Services. In other rare cases, however, we may be unable to send you a notice before terminating your access to our Services.

We will usually notify you in advance of suspending or terminating your Account and/or Services. We may not be able to provide you with notice prior to terminating your use to our Services if your actions violate Section 8 of the General Terms (“Prohibited and Restricted Use”) or any relevant laws and endanger us or another party. However, in other uncommon circumstances, we might not be able to notify you before removing your access to our Services.

Effects on Suspension or Termination.
You will lose access to the Services upon suspension or termination in accordance with these Terms, and you must stop using the Software altogether. The Licence provided in Section 7.1 of these General Terms and any additional licences, if any, will immediately expire without further notice from us at the end of your Subscription or any termination under these Terms. As a result, you must stop using the Software and Services and remove, delete, or return all copies of the Software that are in your possession or under your control.

Survival of Termination.the General Terms will survive termination or expiration of the Terms for any reason, as well as any other Sections of these Terms that, either explicitly or by their nature, must remain in effect even after termination or expiration of these Terms.

APPLICATION PLATFORM TERMS

App Store. If you downloaded our Software from Apple App Store or if you are using such Software and our Services on any Apple-branded device, you acknowledge that you have read, understood, and agree to the following notice regarding Apple:

These Terms are concluded between you and Coinsafe VPN, not with Apple, and Apple is not responsible for the Services and the content thereof. If you need any support with respect to our Services, please contact us, not Apple as they are under no obligation whatsoever to furnish any maintenance or support services with respect to our Services. To the extent that the Services fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Service to you; to the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the Services. Apple is not responsible for addressing any claims by you or any third party relating to the Service or your possession and/or use of the Service, including: (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation. Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party claim that the Service and/or your possession and use of the application infringe that third party’s intellectual property rights. You agree to comply with any applicable third-party terms, when using the Service. Apple, and Apple’s subsidiaries, are third party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary of these Terms. You hereby represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Other Stores. If our Software is downloaded from any other store, platform, marketplace (e.g., Google Play, Amazon Appstore, Microsoft Store, HUAWEI AppGallery), you acknowledge that you have read, understood, and agree to the customer terms of use of such stores, platforms, and marketplace. Coinsafe VPN is the licensor of the Software and the provider of the Services and any third party (e.g., operator of the store, platform, marketplace) is not a party to these Terms.

GOVERNING LAW AND DISPUTE RESOLUTION

Governing Law. These Terms will be governed by the law the United Kingdom. However, some countries (including countries of the European Union) have laws that require contracts to be governed by the mandatory provisions of the local laws of the consumer’s country. In such cases, mandatory provisions of the local laws of your country of residence apply.

Out-of-Court Resolution of Disputes. We always strive to address your concerns without needing a formal legal case. Before filing a claim against Coinsafe, please try to resolve the dispute informally by sending us a written notice of dispute at support@coinsafevpn.com that includes your name, a detailed description of the dispute, and the relief you seek. We will try to resolve the dispute informally by contacting you via email. If a dispute is not resolved, you or Coinsafe may bring a formal proceeding.

Online Dispute Resolution in the EU. If you are a consumer, you may report the dispute to a consumer dispute body in your country of residence, in accordance with local regulations and practices. If you reside in the European Economic Area or Switzerland, the European Commission provides for an online dispute resolution platform, which you can access here: https://ec.europa.eu/consumers/odr.

CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Coinsafe AND YOU AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY IMPLIED CLASS OR REPRESENTATIVE ACTION, TO THE EXTENT PERMITTED BY APPLICABLE LAW. No arbitrator or judge shall consolidate more than one person’s claims, or otherwise preside over any type of a representative or class proceeding, unless both you and Coinsafe VPNagree.

MISCELLANEOUS

Provision of Services. Actual variations in service quality, locations, and speed are possible. At all times, Coinsafe VPNmakes an effort to enhance its services. However, there is a chance that our Services won’t be available without prior notice or without Coinsafe’s liability, including when

• we test, update, expand, add, or remove our Services, features, and functionalities, including those necessary to reflect changes in applicable laws and regulatory requirements
• we experience brief interruptions due to technical issues, maintenance, or human error;
• events outside of our control (such as natural disasters and other events of force majeure) occur.

Modification and Termination of Services.

The functioning of the Services may be changed or updated at any time, for any cause, and without prior warning or liability, at our absolute discretion. In extreme cases, such as when safety or security issues prevent us from doing so, we may also completely suspend the Services. In this case, we will tell you in advance. Your Account and billing information must be up to date in order for us to refund you if you have paid directly to Coinsafe VPNfor a paid Subscription that Coinsafe VPNpermanently ends before the end of its period. In this case, Coinsafe VPNwill refund you the pro rata portion of any prepaid fees for the period following such discontinuation. Coinsafe has no liability to you, nor any obligation to provide a refund to you, in connection with internet or other service outages or failures that are caused by the actions of the authorities, other third parties, or events beyond our control.

Severability.
If any provision of the Terms is found to be unenforceable or invalid by any competent authority, that provision shall be limited or eliminated to the minimum extent necessary so that other provisions of the Terms shall otherwise remain in full force and effect and enforceable.

Assignment.
Without the Coinsafe’s prior written consent, you may not assign these Terms, any rights or interests under these Terms, or any duties to be performed under these Terms. Any of Coinsafe’s rights and duties under these Terms may be assigned, transferred, or delegated to certain third parties without your approval, including but not limited to in the event of a corporate reorganisation, merger, acquisition, sale, or transfer of all or nearly all of the company’s assets. You shall be informed of any significant changes that have an impact on your rights or responsibilities using commercially reasonable methods, such as email.

Data Charges. You are responsible for any charges that may apply to your use of our Services or Websites, including text messaging and data charges if you access or use the Services or Websites on your mobile or other device. If you’re unsure what those charges may be, you should ask your mobile operator, internet, or other service provider before using the Services/Websites.

Third-Party Components.
You acknowledge that third party computer programmes, applications, services, links, and components (referred to as “Third-Party Components”) may be incorporated into, embedded within, merged with, or used in other ways through our Services, Software, and Websites. For the avoidance of dispute, the aforementioned interaction with Third-Party Components is governed by Sections 9 (“Disclaimer of Warranties”) and 10 (“Limitation of Liabilities”) of these General Terms. Links to external websites and/or third-party resources, such as social media websites like Facebook, Instagram, and LinkedIn, that are included on our websites are offered solely for your information. Before engaging in any transaction, please carefully check the terms of use and other rules of the third-party website and make sure you understand them.

Linking to our Websites.
You may link to our Websites, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part where none exists.

Communication with Coinsafe VPN.
You may provide notices, requests, information, and other communications to Coinsafe VPN via our customer support. You agree to receive communications from us electronically, e.g., by email, through our applications, and customer support platforms, and consent that such notifications have the same legal power as communication in writing. We may communicate to you in order to advise you about provision, changes, or additions to the Services or for other purposes that are reasonable or required by applicable law. When communicating with our customer support representatives, you agree to be respectful and kind. In addition, you undertake to provide accurate data for communication with us and, if your contact details have changed, update them in your Account immediately. Coinsafe is not liable if you do not receive certain notices regarding the Services upon your failure to update your contact details.

Internet Connection. Certain Services may require an active and stable connection to the internet in order to function. It is therefore your responsibility to ensure that you have at all times an active and stable internet connection.

Exclusions. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential or incidental damages, so some limitations above may not apply to you.

Prevailing Language.
You acknowledge that third party computer programmes, applications, services, links, and components (referred to as “Third-Party Components”) may be incorporated into, embedded within, merged with, or used in other ways through our Services, Software, and Websites. Force Majeure
If a delay or failure results from unforeseen circumstances, events, or causes beyond Coinsafe VPN’s reasonable control (including, without limitation, failures of third party software (whether open source or not), failures of your telecommunication or internet service providers, force majeure, earthquakes, fires, floods, embargoes, labour disputes), Coinsafe VPN shall not be in breach of the Terms or liable for delay in performing, or failing to perform, any obligations under the Terms. When this occurs, Coinsafe will be granted a reasonable extension of time to complete any such responsibilities outlined in the Terms.

No Reliance.
The parties acknowledge that no reliance is placed on any representation made but not expressly contained in these Terms.
